Medical disclaimer

In an emergency

MediCAPS is not an emergency service. If you or someone else may be in danger, call 112 or go to the nearest hospital straight away.

  • Check results, plans, articles and recipes are general guidance and education. They are not a diagnosis or treatment.
  • Our navigators are medically trained patient navigators. They are not treating doctors, and using MediCAPS does not create a doctor–patient relationship with them.
  • Doctor review, where offered, is limited to the scope described when you book it.
  • Do not delay or ignore professional advice because of something you read or heard on MediCAPS, and follow your own doctor’s advice on medicines and diet.

Insurance and claims support

MediCAPS is not an insurer, a TPA or a hospital. We help you understand your cover and prepare and track claims, but every claim decision is made only by your insurer or TPA. We do not guarantee that a claim will be approved, how fast it will be settled, or how much will be paid.

Coverage reviews rely on the documents you share and may be incomplete. Your policy wording always prevails.

Hospitals, treatment and prices

  • Hospitals, doctors and labs are independent. We do not provide treatment and are not responsible for clinical outcomes.
  • Scorecards use published criteria and help you compare, but they cannot predict how your treatment will go.
  • Fixed-price bundles and quotes come from hospitals and can change after a clinical assessment. Please get final prices in writing.
  • Medical travel carries risks, including visas, travel and complications. Arrange suitable travel and health cover.

Your account and responsibilities

  • Give accurate and complete information.
  • Keep your OTPs, passwords and devices secure, and tell us quickly about any unauthorised use.
  • Add another person’s information only if you are authorised to, and tell them where appropriate.
  • You are responsible for activity under your account.

Your data and consent

We process your health and personal data as described in the Privacy Policy. You control sharing through the consent settings. If you share your locker with family or others, they will see what you allow them to see.

Third-party services

WhatsApp, Google Play, hospitals, labs, insurers and vendors are independent of MediCAPS, and their own terms apply when you use them.

The Millet Kitchen sourcing directory lists products from many vendors. Any related-party supplier is disclosed on its listing. A listing is not an endorsement or a guarantee of quality.

Fees and payments

  • The Free Health & Coverage Check is free.
  • For paid programmes or services, we show the price, what is included and the cancellation and refund terms before you pay.
  • Applicable taxes, including GST, are added where they apply.
  • Hospital, lab, travel and other third-party charges are paid to those providers unless we say otherwise.

Acceptable use

You agree not to:

  • give false information or pretend to be someone else;
  • upload another person’s data without authority;
  • upload malware or interfere with the Services or their security;
  • scrape, copy or reverse-engineer the Services;
  • use the Services for unlawful purposes, to harass our team or partners, or to support a fraudulent insurance claim.

We may report suspected fraud to insurers and the authorities.

Content and intellectual property

The MediCAPS name, logo, website, app, guides, recipes and reports belong to us or our licensors. We give you a limited, personal, non-transferable licence to use them for their intended purpose.

You keep ownership of the documents and data you upload. You give us a limited licence to host, process and display them only to provide the Services and as you direct.

Disclaimers

To the extent the law allows, the Services are provided “as is” and “as available”. We do not promise that they will be uninterrupted or error-free, or that information from partners will be complete or current.

Limitation of liability

To the extent the law allows, MediCAPS is not liable for indirect or consequential loss, for the rejection or delay of a claim, or for the acts and treatment outcomes of independent third parties. Our total liability for any claim relating to a service is limited to the fees you paid us for that service in the 12 months before the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law, or your rights as a consumer.

Indemnity

You agree to compensate MediCAPS for losses arising from your breach of these Terms, false information you provide, or data you upload without authority.

Suspension and ending your use

You can stop using the Services at any time and ask us to delete your account. We may suspend or end your access if you break these Terms, if your use creates risk for others, or if the law requires. Clauses that by nature should continue, such as those on liability and disputes, will continue after your access ends.

Governing law and disputes

These Terms are governed by the laws of India. Please first raise any complaint with us so we can try to resolve it. Subject to your rights as a consumer, including under the Consumer Protection Act, 2019, the courts at New Delhi have jurisdiction over disputes.

Changes to these terms

We may update these Terms from time to time. We will post the new version here with a new date and, for material changes, tell you in the app, by WhatsApp or by email. Continuing to use the Services after a change means you accept it.
